NC Vacations Terms and Conditions
NOTE: Tenant's decision with respect to the purchase of trip interruption insurance will affect Tenant's rights in the event of a mandatory evacuation. See paragraph 8 below. Tax rates are calculated as of the time of this Agreement. Tenant shall
be responsible for all applicable taxes according to rates in effect at the time of occupancy.
Disbursement of Rent and Third Party Fees. Tenant authorizes Agent to disburse prior to Tenant's occupancy of the Premises, up to Fifty Percent (50%) of the rental amount and to disburse the balance of the rent upon the commencement of the
tenancy, a material breach of this Agreement by Tenant, or as otherwise permitted under the Vacation Rental Act. Tenant agrees to pay a $25.00 processing fee for any check of Tenant that may be returned by the financial institution due to insufficient funds
or because Tenant did not have an account at the financial institution. Tenant also authorizes Agent to disburse prior to Tenant's occupancy of the Premises any fees owned to third parties to pay for any goods, services, or benefits procured by Agent for the
benefit of Tenant, including but not limited to any fees set forth herein payable to Agent for Reservation, transfer or cancellation of Tenant's tenancy.
Vacation Rental Damage Coverage. This Vacation Rental Damage plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum
benefit of $3,000. Any damages that exceed $3,000 will be charged to the credit card on file. If you damage the real or personal property assigned to your rental accommodation during the trip, the Insurer will reimburse the lesser of the cost of repairs or
the Actual Cash Value of the property, up to $3,000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy (www.vacationrentalinsurance.com/g10vrd). The Vacation
Rental Damage can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Realty World-First Coast Realty any amount payable under the terms
and conditions of the Vacation Rental Damage. Please contact Realty World-First Coast Realty directly if you do not wish to participate in this plan or assignment.
Trust Account. Any advance payment made by Tenant shall be deposited in a trust account with BB&T located at 2905 Bridges Street, Morehead City, NC. Tenant agrees that any advance payment may be deposited in an interest-bearing trust account
and that any interest thereon shall accrue for the benefit of, and shall be paid to, the owner (or as the owner directs) as it accrues and as often as in permitted by the terms of the account.
Tenant Duties. Tenant agrees to comply with all obligations imposed by the Vacation Rental Act on Tenant with respect to maintenance of the Premises, including but not limited to keeping the Premises as clean and safe as the conditions of
the Premises permit and causing no unsafe or unsanitary conditions in the common areas and remainder of the premises that Tenant uses; and notify Agent in writing of the need of replacement of or repairs to a smoke detector, and replacing the batteries as
needed during the tenancy. Tenant agrees not to use the premise for any activity or purpose that violates any criminal law or governmental regulation. Tenant's breach of any duty contained in this paragraph shall be considered material, and shall result in
the termination of Tenant's tenancy.
Agent Duties. Agent agrees to provide the Premises in a fit and habitable condition. If at the time Tenant is to begin occupancy of the premises, Agent cannot provide the Premises in a fit and habitable condition or substitute a reasonably
comparable property in such condition, Agent shall refund to Tenant all payments made by Tenant. Agent shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap or familial
status of any tenant.
Cancellation. In the event of a cancellation by Tenant, Tenant shall receive a refund of all payments made by Tenant, less an administrative fee of $100 if the Premises are re-rented on the terms set forth herein. If the Premises are not
re-rented on the terms set forth herein, Tenant will not be entitled to a refund of any rent payment made hereunder. Whether or not the Premises are re-rented, Tenant, rather than Agent, shall be responsible for seeking reimbursement of any fees paid by Tenant
to Agent for goods, services, or benefits procured by Agent from third parties for the benefit of Tenant that may have been paid out prior to Tenant's cancellation.
Transfer of Premises. If the owner voluntarily transfers the Premises, Tenant has the right to enforce this Agreement against the grantee of the Premises if Tenant's occupancy under this agreement is to end 180 days or less after the grantee's
interest in the Premises is recorded. If Tenant's occupancy is to end more than 180 days after such recordation, Tenant has no right to enforce the terms of this Agreement unless the grantee agrees in writing to honor this Agreement. If the grantee does not
honor this Agreement, Tenant is entitled to a refund of all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed). Within 10 days after transfer of the Premises, the grantee or the grantee's agent is required to;
(i) notify Tenant in writing of the transfer of the Premises, the grantee's name and address, and the date the grantee's interest was recorded; and (ii) advise Tenant whether Tenant has the right to occupy the Premises subject to the terms of this Agreement
or receive a refund of any payments made by Tenant. Upon termination of the owner's interest in the Premises, whether by sale, assignment, death, appointment of a receiver or otherwise, the owner, owner's agent, or real estate agent is required to transfer
all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed) to the owner's successor-in-interest within 30 days, and notify Tenant by mail of such transfer and of the transferee's name and address. However, if Tenant's
occupancy under this Agreement is to end more than 180 days after recordation of the interest of the owner's successor-in-interest in the Premises, and the successor-in-interest has not agreed to honor this Agreement, all advance rent paid by Tenant (and other
fees owed to third parties not already lawfully disbursed) must be transferred to Tenant within 30 days. If the owner's interest in the premises is involuntarily transferred prior to Tenant's occupancy of the Premises, the owner is required to refund to Tenant
all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed) within 60 days after the transfer.
Mandatory Evacuation. If state or local authorities order a mandatory evacuation of an area that includes the Premises, Tenant shall comply with the order. Upon compliance, Tenant will be entitled to a refund of the prorated rent for each
night that Tenant is unable to occupy the Premises because of the order. However, Tenant will not be entitled to a refund if, prior to taking possession of the Premises: (i) Tenant refused insurance offered by Agent that would have compensated Tenant for losses
or damages resulting from loss of use of the Premises due to a mandatory evacuation order, or (ii) Tenant purchased insurance from Agent.
Vacation Protection Insurance. Realty World-First Coast Realty offers a Vacation Rental Protection Plan. This plan will be offered by CSA. The travel plan charges will be automatically added to your advance rental payment. If you choose
not to purchase the Vacation Rental Protection Plan you may decline this charge by initialing where indicated on your Vacation Rental Agreement. This plan is optional but we strongly recommend it. In the case of unforeseen events, this travel insurance protects
you and your family from a vacation fiasco. If you choose not to purchase the travel plan no refunds will be given in the event of unforeseeable cancellations including hurricane evacuations. A brochure describing this service will be mailed with the Vacation
Rental Agreement. The protection must be in place upon final payment and does not start until it is paid in full. Realty World-First Coast Realty earns a commission on the Vacation Rental Protection Plan to cover administrative costs. Cancellation of insurance
must be made within 10 days of receipt of confirmation to qualify for a refund and before final payment is made.
Expedited Eviction. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. Tenant may be evicted under such procedures is Tenant: (i) hold over in possession
after the Tenant's tenancy has expired; (ii) commits a material breach of any provision of this Agreement (including any addendum hereto) that according to its terms would result in the termination of Tenant's tenancy; (iii) fails to pay rent as required by
this Agreement; or (iv) has obtained possession of the Premises by fraud or misrepresentation.
Indemnification and Hold harmless; Right of Entry; Assignment. Tenant agrees to indemnify and hold harmless Agent and the owner from and against any liability for personal injury or property damage sustained by any person (including Tenant's
guests) as a result of any cause, unless caused by the negligent or willful act of Agent or the owner, or the failure of the Agent or the owner to comply with the Vacation Rental Act. Tenant agrees that Agent, the owner or their respective representatives
may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Agent or owner may deem appropriate, or to show the Premises to prospective purchasers or tenants. Tenant shall not assign
this Agreement or sublet the Premises in whole or part without written permission of Agent.
Pets. Unless otherwise specifically permitted in this Agreement (including any addendum hereto), no pets shall be allowed on the Premises. Tenant's breach of this provision shall be considered material, and shall result in termination of
REALTY WORLD-FIRST COAST REALTY rents only to family groups, married couples, and responsible adults over the age of 25. NO HOUSE PARTIES ALLOWED. Misrepresentation will result in tenant asked to immediately vacate the property without refund.
All Units rent from Sunday to Sunday or Saturday to Saturday.
Rental deposits not received within the required 10 day period will result in cancellation of your reservation booking. Acceptable methods of payment will be personal checks, traveler's checks, cashiers checks, money orders, certified funds or MasterCard or
Reservations may be made by telephone or online at our website. The required reservation deposit is equal to one-half of the rental amount and any applicable insurance premium. Your deposit is due and payable within 10 days from the date
of booking in order to confirm your reservation. We will send you a Vacation Rental Agreement and Addendum and the information about Travel Protection Insurance. Please read, sign and return the Vacation Rental Agreement & Addendum within 10 days of receipt.
At this time if you decline Travel Protection Insurance the amount collected for the insurance will be deducted from the balance owed. Failure to return the signed Vacation Rental Agreement & Addendum may result in cancellation of your reservation. All reservations
will have a non-refundable taxable Administration/Reservation Fee added to them of $75.00.
Your Balance Due. (total less your Reservation Deposit) must be received in our office thirty (30) days prior to your arrival date. You may pay with personal check provided final payment is made at least thirty (30) days prior to your arrival.
For reservations made less than thirty (30) days of arrival/check-in date, payment must be travelers check, certified funds, cashiers check, money order or Mastercard, Visa.
Taxes. At the time of printing all rents are subject to 7.75% NC sales tax, 5% Carteret County occupancy tax, for a total of 12.75%.
CHECK-IN : Check in time is AFTER 3:30 PM. However we reserve the right to extend the check in time to 6:00 PM if necessary, to allow for extra time for cleaning and maintenance. EARLY ARRIVALS are at your own risk, we cannot guarantee early
check-in because we must have time to clean and inspect the units before you take possession. Upon arrival, please pick up the keys to your property at the appropriate REALTY WORLD-FIRST COAST REALTY office. For Emerald Isle area rentals, check in at 7413
EMERALD DRIVE, EMERALD ISLE, N.C. For Atlantic Beach and other area rentals, check in at 407 ATLANTIC BEACH CAUSEWAY SUITE 1, ATLANTIC BEACH, N.C.
LATE ARRIVALS: If you will be arriving after 5:00 PM please notify our office to request arrangements for late arrival.
RENTAL PERIODS: There is a minimum of one-week rental for advance booking during the SUMMER SEASON: MAY 31 through SEPTEMBER 12. Weekend reservations are only booked on an "as available basis" by calling our office on Tuesday for the following
weekend. A two-night minimum is required. A three-night minimum is required for all Holiday Weekends.
RULES AND REGULATIONS: Absolutely no grilling on porches or balconies, use only in designated areas. Most condominium complexes have printed rules and regulations. Tenants are subject to these. Violation may result in immediate eviction
without refund or recourse.
TERMINATION OF RENTAL: REALTY WORLD-FIRST COAST REALTY RESERVES THE RIGHT TO REFUSE OR TERMINATE OCCUPANCY IF IN OUR JUDGEMENT IT COULD PROVE DETRIMENTAL TO THE PROPERTY. If the owner of your vacation residence removes his property from
availability, or if the property becomes unavailable for any reason, agent reserves the right to substitute comparable accommodations or refund deposit.
CUSTOMER SERVICE: After your reservation has been made if you have any questions, we will be pleased to answer them for you on our customer service number (252) 247-5150 as we cannot accept any other than reservation requests on our 800
line. CUSTOMER SERVICE: (252) 247-5150.
LINENS: Linens are included in our all inclusive pricing for full weekly rentals. Properties that provide turndown service will have the beds made upon arrival and removed upon check out. For stays less than a week, you may bring your own
linens from home or purchase them from Island Essentials Supply. Our office is happy to provide you with this information. For linen emergencies, please call the contact number provided with your check-in packet.
CLEANING POLICY: Basic cleaning, sanitizing and general hygiene protection is included in the rental price. It does NOT include making beds, dish washing, or trash removal. Guests will be charged for these services.
HOUSEKEEPING: Upon arrival if you find that your rental unit is not cleaned satisfactorily or if there is another problem, you must report it to us within one hour of check-in so that the problem can be corrected at that time. Please do
GARBAGE AND TRASH: Please place garbage inside trash receptacle in sufficient time for pick up in your area and place by street. Collection time begins at 7:00 am Monday through Thursday. Trash left on top of overturned trashcans is unacceptable.
ACCOMMODATIONS: All of our vacation properties are individually owned and reflect each owner's taste and requirements. These differences in ownership contribute to each properties identity. Neither agent nor owner shall be responsible for
providing any additional furnishings not presently available in the unit. IF YOU HAVE SPECIFIC STANDARDS OR REQUIREMENTS FOR YOUR VACATION RESIDENCE, WE SUGGEST YOU COME TO OUR OFFICE PRIOR TO MAKING YOUR RESERVATION. WE CANNOT MAKE SUBSTITUTIONS OR GIVE REFUNDS
UPON YOUR ARRIVAL.
PARKING: All condominium units allow a maximum of two vehicles per unit. A few permit towed vehicle parking. If you have specific needs regarding vehicles please discuss them when you make your reservation. Hookup or any use of campers,
motor homes, travel trailers, vans, buses or tents is against city ordinance and not allowed.
SUBLEASING: This agreement may not be assigned or subleased without prior written consent. Unit keys will only be issued to the person who made the reservation. Identification will be requested at check-in.
LOCKED CLOSETS: Many owners have a locked closet for their convenience. These areas are absolutely not included in this rental.
LOCK OUT POLICY: In the event a tenant is locked out of the unit, the tenant can borrow a key by coming to the office. After business hours until 11 PM, the tenant may call 252-247-5150. An agent will meet the tenant at the office. A charge
of $50 is payable for obtaining the key after business hours. No agent is available for late hour calls after 11 PM. A locksmith will be required at the renter's expense.
ROUTINE MAINTENANCE: It may be necessary for us to enter the unit during reasonable hours to perform minor repairs.
REPAIR AND SERVICE CALLS: We cannot guarantee against mechanical failure of heating, air conditioning, TVs, VCRs, or other appliances. Please report any inoperative equipment to our office promptly. We will make every effort to have repairs
done quickly and efficiently. Should a Repair Person make a call to a unit and find the equipment is in working order and the problem was due to tenant oversight or neglect, the charge for service will be deducted from the damage deposit.
NO REFUNDS OR RENT DEDUCTIONS WILL BE MADE DUE TO FAILURE OF HEATING, AIR CONDITIONING, TVs, VCRs, or any other appliances. All maintenance requests must be reported to the office between 9 AM and 5 PM.
CAPACITY: Units are furnished and supplied for a reasonable number of guests. Occupancy is limited to two persons per bedroom. If you have questions concerning sleeping arrangements, please ask us. Overcrowding will result in eviction without
KEYS, CAR PASSES, GATE CONTROL CARDS, POOL PASSES: You will be issued these items at check in if the unit you have reserved require them. All keys, passes, gate cards and tags must be returned to the office where you picked them up at check
out. ANY ITEMS NOT ACCOUNTED FOR MUST BE PAID FOR AT THAT TIME. There is a $75.00 charge for re-keying a unit if a key is unaccounted for or lost. There is a charge of $120.00 for each gate card, $50..00 for each car pass and $10.00 for each pool tag not turned
in at checkout.
CHECK OUT TIME: By 10:30 AM NO EXCEPTIONS. Check out takes place at our office. The unit is to be completely vacated before returning all keys, parking passes, gate cards and pool tags to our rental office. An extra fee will be charged for
late check out - equal to a nights rent. All trash must be placed in plastic bags and deposited in the outside trash receptacle. Trashcans at houses need to be taken to the street. Dishes must be washed, dried and put away, the furniture in the unit put back
where it was found and the unit left neat and in order. If you fail to comply with any of these items requirements you will be charged, there is a $15.00 fee for dishes, $15.00 fee for trash left and a $15.00 fee for moving furniture.
INCLEMENT WEATHER: No refunds will be made due to inclement weather.
MESSAGES AND MAIL: Messages and mail can be received through and picked up at our office on the causeway. We do no deliver messages. Address mail to: REALTY WORLD-FIRST COAST REALTY P.O. BOX 2829, ATLANTIC BEACH, NC 28512. Please put your
name and unit you are staying in at the bottom left corner. For someone staying a week or less, overnight mail would be advisable. If you use UPS or Federal Express our physical address is 407 Atlantic Beach Causeway, Suite 1.
LOST & FOUND: Realty World-First Coast is not responsible for items left behind. However, we make every effort to locate and return lost items to you. You must notify our staff promptly of your missing items. You must contact our office
and we return items found via UPS or USPS for the cost of mailing plus a $25.00 handling fee. We donate unclaimed items to local charities at the end of each month.
TELEPHONES: Most rental units have telephones for your convenience, NOT ALL UNITS HAVE PHONES AND PHONES WILL NOT BE PLACED IN THESE UNITS. Please do not place or accept any calls charged to the property phone. All long distance calls must
be made collect or billed to home numbers or credit cards. Any calls billed to the unit including Directory Assistance and Call Return Service will be charged to you by Realty World-First Coast Realty plus a $75 service charge.
What to Bring: We suggest you may want to bring the following items to make your vacation run a little more smoothly. Paper towels, toilet paper, bath soap, trash bags, face cloths, all purpose cleaners, aluminum and plastic wrap, laundry
detergent, towels, staple items, condiments, beach towels, beach chairs, napkins, dishwashing detergent, dish towels and bath mats.
Tenant agrees that Tenant has received and read any such addenda, and that they shall constitute an integral part of this Agreement.
